By accessing or using Kineke ("the Service"), operated by Kineke ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to use the Service. By using Kineke, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms. If you are under 18, you must have parental or guardian consent.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete registration information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access or use of your account
  • Not share your account or transfer it to another person

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

4. User Content

You retain ownership of the content you create and share on Kineke ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, distribute, and modify your content in connection with operating and improving the Service.

You are solely responsible for your User Content and agree that:

  • You have the right to post the content
  • Your content does not infringe on any third-party rights
  • Your content complies with applicable laws and these Terms

We reserve the right to remove any content that violates these Terms or our Community Guidelines, at our sole discretion.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Harass, bully, intimidate, or threaten other users
  • Post content that is hateful, violent, sexually explicit, or discriminatory
  • Impersonate any person or entity
  • Engage in spam, phishing, or deceptive practices
  • Attempt to gain unauthorized access to other accounts or systems
  • Use bots, scrapers, or automated tools without permission
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent any content moderation or safety measures
  • Violate any applicable laws or regulations

6. Marketplace Terms

Kineke may provide a marketplace feature allowing users to buy, sell, or exchange goods and services. When using the marketplace:

  • You are responsible for the accuracy of your listings and the quality of goods or services offered
  • Kineke acts as a platform facilitator and is not a party to transactions between users
  • All transactions are between the buyer and seller; we are not responsible for disputes
  • You must comply with all applicable consumer protection and commerce laws
  • We may charge service fees for marketplace transactions as disclosed on the platform

7. Intellectual Property

The Service, including its design, features, code, graphics, logos, and branding, is owned by Kineke and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our express written permission.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Any content on the Service is accurate, reliable, or complete
  • Defects will be corrected in a timely manner
  • The Service is free of viruses or other harmful components

9. Limitation of Liability

To the maximum extent permitted by law, Kineke and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid to Kineke in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Termination

You may deactivate your account at any time through your account settings. We may suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kineke operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
